{"id":101651,"date":"2024-02-08T10:02:44","date_gmt":"2024-02-08T09:02:44","guid":{"rendered":"https:\/\/www.aisdue.eu\/?p=101651"},"modified":"2024-02-08T14:19:46","modified_gmt":"2024-02-08T13:19:46","slug":"fabio-ferraro-evoluzione-o-involuzione-del-diritto-della-concorrenza-nella-sentenza-superleague","status":"publish","type":"post","link":"https:\/\/www.aisdue.eu\/en\/fabio-ferraro-evoluzione-o-involuzione-del-diritto-della-concorrenza-nella-sentenza-superleague\/","title":{"rendered":"FABIO FERRARO, Evoluzione o involuzione del diritto della concorrenza nella sentenza Superleague?"},"content":{"rendered":"\n<p><strong>Abstract (ITA)<\/strong><\/p>\n\n\n\n<p>Il presente contributo intende soffermarsi sulla recente sentenza della Corte di giustizia resa nel caso <em>Superleague<\/em>, ma collocandosi in una limitata prospettiva di indagine, in quanto intende formulare talune riflessioni su tre principali questioni di diritto della concorrenza da essa affrontate nella pronuncia, vale a dire il \u201cconflitto\u201d tra la competenza dell\u2019Unione in materia di sport (art. 165 TFUE) e quella nel settore <em>antitrust<\/em>, l\u2019influenza dell\u2019art. 106 TFUE nella valutazione degli artt. 101 e 102 TFUE e l\u2019esclusione dell\u2019eccezione <em>Wouters<\/em> nelle restrizioni della concorrenza per oggetto. L\u2019obiettivo \u00e8 anche, e soprattutto, quello di rispondere all\u2019interrogativo se il <em>decisum<\/em> della Corte di giustizia rappresenti un\u2019evoluzione o un\u2019involuzione del diritto della concorrenza dell\u2019Unione europea.<\/p>\n\n\n\n<p><strong>Abstract (ENG)<\/strong><\/p>\n\n\n\n<p>The paper aims to focus on the recent judgment of the Court of Justice in the <em>Superleague<\/em> case, but with a limited investigative perspective. It intends to propose reflections on three main competition law issues addressed in the ruling, namely the \u2018conflict\u2019 between the EU competence in sports matters (Article 165 TFEU) and the one in the antitrust, the influence of Article 106 TFEU in assessing Articles 101 and 102 TFEU, and the exclusion of the <em>Wouters<\/em> exception in restrictions of competition by object.
