La ricostruzione del quadro normativo di riferimento, il limite dell\u2019accesso al giudice da parte delle ONG previsto dalla \u201cdottrina <em>Plaumann<\/em>\u201d e l\u2019interazione dei diversi mezzi di tutela multilivello, definiscono nell\u2019insieme una architettura complessa che, sebbene non sia esente da critiche, ha una sua coerenza e non scalfisce formalmente l\u2019effettivit\u00e0 del sistema unitariamente considerato. E se per un verso la recente pronuncia della Corte di Strasburgo nel caso <em>KlimaSeniorinnen<\/em> pone nuovamente al centro del dibattito il ruolo dei giudici e l\u2019equilibrio raggiunto nel sistema di garanzia dei singoli nell\u2019ordinamento dell\u2019Unione europea, per l\u2019altro si ritiene che rafforzare la partecipazione attiva delle ONG nel procedimento che conduce all\u2019adozione di misure vincolanti in tema di ambiente sia la via maestra per la salvaguardia del pianeta.<\/p>\n\n\n\n<p><strong>Abstract (ENG)<\/strong><\/p>\n\n\n\n<p>Climate change litigation, and in particular the availability of legal remedies against norms adopted by the European institutions, is the test case for assessing the effectiveness of judicial protection in the European Union\u2019s legal system and, consequently, its effectiveness itself. The reconstruction of the legal reference framework, the limitation of the access of NGOs to the courts provided for by the \u201c<em>Plaumann<\/em> doctrine\u201d and the interaction of the various tools of multi-level protection, all together define a complex architecture which, albeit not exempt from criticism, has its own coherence and does not formally undermine the effectiveness of the system as a whole.
