Ai sensi del regolamento Frontex 2019\/1896, le responsabilit\u00e0 di Frontex per l\u2019individuazione e la protezione delle vittime di tratta sono limitate al coordinamento e al supporto, mentre la responsabilit\u00e0 primaria per l\u2019identificazione operativa delle vittime spetta agli Stati membri. La direttiva 2011\/36 contro la tratta di esseri umani, la sua rifusione nella direttiva 2024\/1712 e la strategia 2021-2025 dell\u2019UE sulla tratta di esseri umani sostengono un approccio basato sui diritti umani che d\u00e0 priorit\u00e0 alla prevenzione, alla protezione delle vittime e al perseguimento dei trafficanti. Le proposte per un meccanismo europeo di <em>referral<\/em>, facilitato dalle agenzie dell\u2019UE, evidenziano la necessit\u00e0 di una rapida identificazione e protezione delle vittime. Il presente contributo sostiene che il potenziamento della collaborazione tra Frontex, le ONG e gli Stati membri, insieme al rafforzamento del mandato dell\u2019Agenzia, \u00e8 essenziale per migliorare la sua capacit\u00e0 di combattere la tratta di esseri umani in modo completo e allinearsi alle direttive anti-tratta dell\u2019UE e agli obblighi in materia di diritti umani.<\/p>\n\n\n\n<p><strong>Abstract (ENG)<\/strong><\/p>\n\n\n\n<p>This paper explores the role of Frontex in addressing human trafficking within the European Union. Under the 2019 Frontex Regulation 2019\/1896, Frontex\u2019s responsibilities for detecting and protecting trafficking victims are limited to coordination and support, with the primary responsibility for operational victim identification resting with Member States. The EU Anti-Trafficking Directive 2011\/36, its recast Directive 2024\/1712, and the 2021-2025 EU Strategy on human trafficking advocate a human rights-based approach prioritising prevention, victim protection, and prosecution of traffickers. Proposals for a European Referral Mechanism, facilitated by EU Agencies, highlight the need for prompt identification and protection of victims.
