Evidenzia come alcune garanzie comuni, in particolare quelle volte a promuovere l\u2019autosufficienza e la partecipazione sociale del richiedente protezione, risultano rafforzate. Si sofferma sulle modifiche che hanno recepito la giurisprudenza della Corte di giustizia, legando in maniera esplicita il trattamento minimo da riservare a tutti i richiedenti al rispetto della dignit\u00e0 della persona protetta dalla Carta e dagli obblighi internazionali degli Stati. Allo stesso tempo, tuttavia, l\u2019obiettivo di reprimere i movimenti secondari \u00e8 perseguito con misure pi\u00f9 incisive rispetto al passato. Questo approccio determina un trattamento deteriore per i richiedenti protezione che non si trovano nello Stato designato in base al diritto derivato, in contrasto le logiche di eguaglianza e unitariet\u00e0 perseguite dalla giurisprudenza.<\/p>\n\n\n\n<p><strong>Abstract (ENG)<\/strong><\/p>\n\n\n\n<p>The article examines the key provisions of the new \u201creception conditions\u201d directive, highlighting its most critical junctures. It emphasizes how certain common safeguards, particularly those aimed at promoting the self-sufficiency and social participation of the asylum seeker, are strengthened. It focuses on the amendments that have incorporated the case-law of the Court of Justice, linking in an explicit manner the minimum treatment to be reserved for all applicants to the respect for human dignity protected by the Charter and the international obligations of States. At the same time, however, the objective of repressing secondary movements is pursued through harsher measures than in the past.
