Many international agreements concluded by the EU in the second decade of the 21<sup>st<\/sup> century include articles that do not sufficiently guarantee the fundamental rights to privacy and personal data protection. For this reason, in 2018, the EU Commission endorsed the \u201cHorizontal provisions for cross-border data flows and for personal data protection\u201d, to be inserted in subsequent EU trade agreements in place of \u201cold-fashioned\u201d articles. However, some initial examples of the implementation of the Horizontal clauses have not been encouraging, since such provisions were modified in the most important aspects. The EU-Chile ITA, instead, can be qualified as a positive example: the Horizontal provisions, indeed, are quite faithfully reproduced in articles 19.5 and 19.6, which offer improved safeguards for privacy and personal data protection compared to previous instruments.<\/p>\n\n\n\n<p><strong>Abstract (ITA)<\/strong><\/p>\n\n\n\n<p>Il contributo prende in considerazione le <em>data protection provisions<\/em> contenute nel nuovo <em>Interim Trade Agreement<\/em> (ITA) tra l\u2019UE e il Cile \u2013 entrato in vigore sabato 1\u00b0 febbraio 2025 \u2013 e mette in evidenza le ragioni per cui esse rappresentano un passo avanti rispetto al passato. Numerosi accordi internazionali conclusi dall\u2019UE nel secondo decennio del XXI secolo includono articoli che non tutelano sufficientemente i diritti fondamentali alla <em>privacy<\/em> e alla protezione dei dati personali. Perci\u00f2, nel 2018, la Commissione europea ha approvato le \u201c<em>Horizontal provisions for cross-border data flows and for personal data protection<\/em>\u201d, da inserire nei successivi accordi commerciali dell\u2019UE in sostituzione degli articoli \u201cvecchio stampo\u201d. Tuttavia, alcuni primi esempi di attuazione delle clausole orizzontali non sono stati incoraggianti, poich\u00e9 tali disposizioni sono state modificate nei loro aspetti pi\u00f9 rilevanti.
