Il presente contributo analizza criticamente tale regolamento, interrogandosi sulla coerenza tra l\u2019enunciazione dell\u2019obiettivo e l\u2019effettivit\u00e0 del sistema di <em>governance<\/em> e dei meccanismi attuativi previsti. Particolare attenzione \u00e8 dedicata all\u2019assenza di una prospettiva basata sui diritti fondamentali, in particolare del riconoscimento di un diritto al clima stabile. In tale contesto, si prospetta un possibile intervento anticipatorio della Corte di giustizia che, basandosi e rafforzando l\u2019approccio di recente adottato dalla Corte europea dei diritti dell\u2019uomo nel caso <em>Verein KlimaSeniorinnen Schweiz e a.\/Svizzera<\/em>, potrebbe gettare le fondamenta per il riconoscimento di un diritto al clima, che integrerebbe e rafforzerebbe gli obblighi esistenti degli Stati di rispettarlo e proteggerlo.<\/p>\n\n\n\n<p><strong>Abstract (ENG)<\/strong><\/p>\n\n\n\n<p>The European Union has traditionally been at the forefront of the fight against climate change, following an approach that has gradually evolved into the development of a genuine European climate policy. This process culminated in the adoption of Regulation (EU) 2021\/1119 (\u201cEuropean Climate Law\u201d), which enshrines the legally binding objective of climate neutrality by 2050. This contribution offers a critical analysis of the Regulation, questioning the consistency between the stated objective and the effectiveness of the governance framework and implementation mechanisms provided. Particular attention is devoted to the absence of a fundamental rights-based perspective, notably the lack of recognition of a right to a stable climate. In this context, the paper considers the possibility of anticipatory judicial intervention by the Court of Justice, which \u2013 building upon and reinforcing the approach recently adopted by the European Court of Human Rights in <em>Verein KlimaSeniorinnen Schweiz and Others v.
