Sebbene la direttiva UE 2008\/99 sulla tutela penale dell\u2019ambiente abbia dato un primo impulso alla materia, l\u2019aumento dei reati ambientali connesso alla ineffettivit\u00e0 del regime sanzionatorio ivi previsto dimostra come essa non sia riuscita a colmare le lacune esistenti.&nbsp;In risposta a queste criticit\u00e0, \u00e8 stata introdotta la recente direttiva UE 2024\/1203, espressione di un mutato approccio strategico dell\u2019Unione, che si traduce nel passaggio da un modello minimalista, incentrato sulla previsione di poche norme e definizioni vaghe, ad un modello integrale, caratterizzato da un dettato normativo articolato e di dettaglio. L\u2019autore svolge alcune considerazioni di carattere generale sull\u2019efficacia di tale revisione legislativa in attesa del suo recepimento, esaminando le implicazioni che essa avr\u00e0 sugli ordinamenti interni, in particolare quello italiano, che dovranno implementare le nuove e pi\u00f9 stringenti misure.<strong><\/strong><\/p>\n\n\n\n<p><strong>Abstract (ENG)<\/strong><\/p>\n\n\n\n<p>This paper analyzes the evolution of the European Union\u2019s efforts to combat environmental crime. While the EU Environmental Crime Directive 2008\/99 provided an initial impetus to this field, the persistent rise in environmental offenses, coupled with the ineffectiveness of its sanctioning regime, demonstrates its failure to address existing gaps. In response to these critical shortcomings, the recent EU Directive 2024\/1203 has been introduced. This new instrument reflects a significant shift in the Union\u2019s strategic approach, moving from a minimalist model \u2013 characterized by limited provisions and vague definitions \u2013 towards a comprehensive framework with detailed and articulated legislative mandates. The author offers general considerations regarding the efficacy of this legislative revision, anticipating its transposition.
