Tuttavia, queste affermazioni rischiano di rimanere solo sulla carta per quanto riguarda l\u2019uso dell\u2019Intelligenza Artificiale. Nonostante i numerosi atti legislativi che sono stati proposti o adottati dall\u2019UE nell\u2019ultimo quinquennio, ivi compresi quelli in attuazione del Green Deal europeo, infatti, la disciplina predisposta non \u00e8 adeguata a garantire che il processo produttivo che porta alla creazione di sistemi di IA sia circolare. La disciplina oggi esistente, spesso a scapito della salubrit\u00e0 ambientale di Paesi extra-UE, non garantisce, infatti, n\u00e9 che l\u2019UE riduca la propria domanda di materie prime per la produzione di sistemi di IA, n\u00e9 che si usi meno energia per la produzione e il consumo di tecnologie basate sull\u2019IA. N\u00e8 tantomeno \u00e8 previsto un sistema efficiente di riutilizzo dei rifiuti generati dai sistemi di IA. Questo contributo si propone, pertanto, di esplorare questo tema cruciale, non ancora diffusamente approfondito in dottrina, e di verificare fino a che punto la doppia transizione \u201cverde\u201d e \u201cdigitale\u201d vadano nella stessa direzione. A tal fine, studieremo il ruolo che l\u2019UE svolge in questo contesto, analizzando, pur senza pretesa di esaustivit\u00e0, le lacune esistenti nel diritto UE e valutando fino a che punto l\u2019esternalizzazione dei costi negativi in Paesi extra-UE sia legittimo per il diritto UE, ossia fino a che punto si estenda l\u2019eventuale portata extraterritoriale dei diritti previsti nella Carta dei diritti fondamentali dell\u2019UE. Alla luce di tale analisi, quindi, indicheremo nelle conclusioni quale, a nostro avviso, sia la strada migliore da percorrere alla luce del diritto dell\u2019Unione per proteggere l\u2019ambiente e tutelare i diritti delle popolazioni locali in Paesi extra-UE.<\/p>\n\n\n\n<p><strong>Abstract (ENG)<\/strong><\/p>\n\n\n\n<p>The circular economy, as stated by the European Commissioner for the Environment in 2022, should allow the EU to reduce its demand for raw materials, and to use less energy for the production and consumption of goods. However, these statements risk remaining only on paper as regards the use of Artificial Intelligence. Despite the numerous legislative acts that have been proposed or adopted by the EU in the last five years, including those implementing the European Green Deal, in fact, the current legal framework is not adequate to ensure that the production of AI systems is circular. The current legislation, often to the detriment of the environment of non-EU countries, does not guarantee, in fact, that the EU will reduce its demand for raw materials to produce AI systems, nor that less energy will be used for the production and consumption of AI-based technologies. Nor is there an efficient system for the reuse of E-waste generated by AI systems. This contribution aims to explore this crucial issue, not yet widely explored in doctrine, and to verify to what extent the double \u201cgreen\u201d and \u201cdigital\u201d transitions go in the same direction. To this end, we will examine the role that the EU plays in this context, analysing, without claiming to be exhaustive, the gaps existing in EU law and assessing to what extent the externalisation of negative costs to non-EU countries is legitimate under EU law, i.e. to what extent the rights enshrined in the Charter of Fundamental Rights of the EU apply extraterritorially.
