Il presente contributo analizza il quadro normativo vigente nell\u2019Unione europea alla luce delle sfide poste dall\u2019uso delle opere protette nei processi di addestramento dei modelli generativi, con particolare attenzione all\u2019articolazione tra eccezioni per il <em>text and data mining<\/em>, <em>AI Act<\/em> e <em>GPAI Code of Practice<\/em>. Dopo un confronto con gli approcci adottati in altre giurisdizioni (Stati Uniti, Giappone, Cina, Regno Unito, Canada), si esaminano due principali modelli per la remunerazione degli autori: uno <em>input-based<\/em>, fondato sull\u2019<em>opt-out <\/em>e sulle licenze remunerate; l\u2019altro <em>output-based<\/em>, incentrato su un sistema di compensazione collettiva (<em>AI levy<\/em>). Il contributo sostiene la necessit\u00e0 di integrare entrambi gli approcci, al fine di tutelare la creativit\u00e0 umana e garantire un\u2019equa redistribuzione del valore in un contesto di forte competizione globale, salvaguardando al contempo l\u2019autonomia culturale e tecnologica dell\u2019Unione europea.<\/p>\n\n\n\n<p><strong>Abstract <\/strong><strong>(ENG)<\/strong><\/p>\n\n\n\n<p>The rise of generative artificial intelligence calls for a deep reassessment of the copyright system\u2019s ability to respond to technological disruption. This paper analyzes the current legal framework in the European Union in light of the challenges posed by the use of copyrighted works in the training of generative models, with a particular focus on the interplay between text and data mining (TDM) exceptions, the AI Act, and the GPAI Code of Practice. After a comparative overview of other jurisdictions (United States, Japan, China, Israel, Canada), the paper explores two main models for author remuneration: an input-based approach relying on opt-outs and licensing, and an output-based model centered on a collective compensation scheme (AI levy).
