Poich\u00e9 il mercato dell\u2019IA \u00e8 gi\u00e0 un oligopolio, l\u2019impiego esclusivo di tali tecnologie da parte dei grandi operatori e la loro facilit\u00e0 di acquisire nuove realt\u00e0 possono accentuare la concentrazione di potere. La ricerca analizza <em>AI Act<\/em>, <em>Digital Services Act<\/em> e, soprattutto, <em>Digital Markets Act<\/em>. Una particolare attenzione spetta, poi, all\u2019esame del GDPR: infatti, i dati costituiscono il principale nutrimento dei sistemi algoritmici. I regolamenti richiamati saranno esaminati alla luce dell\u2019art. 102 TFUE per comprendere quando le posizioni dominanti \u201clegittime\u201d dei <em>gatekeepers<\/em> possano divenire abusive. \u00c8 proprio da questo interrogativo che si perviene al tema <em>core<\/em> che ci si propone di affrontare per giungere all\u2019individuazione delle migliori prospettive capaci di favorire sia la prosperazione del mercato interno, sia l\u2019evoluzione e l\u2019immissione della tecnologia nel mercato stesso.<\/p>\n\n\n\n<p><strong>Abstract<\/strong><strong> (ENG)<\/strong><\/p>\n\n\n\n<p>Companies The text examines the competition risks arising from the use of AI and the large-scale collection of data by major companies, which widens the gap with smaller firms and consumers. Since the AI market is already an oligopoly, the exclusive use of such technologies by large operators and their ability to easily acquire new entrants may further concentrate market power. The research analyses the AI Act, the Digital Services Act, and, above all, the Digital Markets Act. Particular attention is also given to the GDPR, as data constitute the primary fuel of algorithmic systems. These regulations will be examined in light of Article 102 TFEU to understand when the \u201clegitimate\u201d dominant positions of gatekeepers may become abusive.
