Tali strumenti si intersecano per l\u2019ambito di applicazione, di non precisa definizione, e per le competenze ripartite tra autorit\u00e0 nazionali ed europee coinvolte, costituendo una base giuridica frammentata per sostenere la legittimit\u00e0 del cumulo di profili sanzionatori eventualmente applicabili dalla Commissione. Gli strumenti regolatori addottati dall\u2019Unione, volti alla creazione di una rete per la protezione dei consumatori e alla salvaguardia della concorrenza, sebbene testimonino la tendenza espansiva delle competenze dell\u2019Unione, tuttavia non arginano lo squilibrio di poteri tra le parti. Il contributo ricostruisce un avvio d\u2019interpretazione estensiva della giurisprudenza di Lussemburgo di alcuni elementi cardine del diritto della concorrenza, come per esempio l\u2019abuso di posizione dominante, per applicarli alle peculiarit\u00e0 del settore digitale.<\/p>\n\n\n\n<p><strong>Abstract (ENG)<\/strong><\/p>\n\n\n\n<p>The paper aim to analyze the interaction between different instruments \u2013 regulatory nature \u2013 recently adopted by the EC in the \u201cdigital ecosystem\u201d. These instruments overlap, due to their scope of application and the shared competences between national and European authorities, determining an inconsistent legal basis for cumulative sanctions, eventually imposed by the EC. The regulatory instruments adopted by the Union, aimed at creating a net for consumer protection and protection of the competition, while demonstrating the Union\u2019s expansive tendency, however do not solve the imbalance of power between the parties involved.
