As an automated tool for assessing creditworthiness, it affects human dignity, the principle of equality, and the protection of personal data. The Court of Justice of the European Union is assuming a central role in safeguarding these rights, through an extensive interpretation of the notions and principles established by the current legal framework, particularly the GDPR and the Consumer Credit Directive. The Union legislator, although having the opportunity to adopt this rights-oriented approach within the AI Act, has instead opted for a minimal regulation, merely prohibiting the most extreme forms of credit scoring. Such a regulatory approach risks generating tensions between the supranational legal system and the ones of the Member States. Moreover, the broad wording employed by the EU legislator, together with the wide powers conferred on the European Commission, puts the Union’s delicate institutional balance to the test.

DOWNLOAD IN FORMATO PDF

Abstract (ITA) Tra le pratiche di profilazione e categorizzazione sociale, il credit scoring rappresenta un punto di frizione significativo tra innovazione tecnologica e tutela dei diritti fondamentali.

[161

post-108844","post","type-post","status-publish","format-standard","hentry","category-post-articoli
["GET
