La pronuncia della Corte rappresenta un punto di approdo significativo nel percorso, tutt\u2019altro che lineare, di tutela dei diritti delle persone appartenenti a minoranze sessuali nell\u2019ordinamento dell\u2019Unione, collocandosi all\u2019interno di un quadro segnato da una crescente tensione tra l\u2019affermazione dei valori di uguaglianza, dignit\u00e0 umana e non discriminazione e l\u2019adozione, in alcuni Stati membri, di normative sostanzialmente dirette a limitare la visibilit\u00e0 pubblica delle identit\u00e0 sessuali e di genere non conformi al modello maggioritario. In tale contesto, la decisione della Corte risulta importante non soltanto per le soluzioni giuridiche adottate, ma anche per il modo in cui essa ricostruisce &#8211; secondo un orientamento consolidato &#8211; il rapporto tra libert\u00e0 fondamentali del mercato interno e diritti fondamentali della persona, ponendo questi ultimi al centro del sindacato di legittimit\u00e0. Ne deriva una presa di posizione netta rispetto a quelle normative che, sotto la veste di interventi protettivi, finiscono per tradursi in forme di stigmatizzazione e marginalizzazione delle persone LGBTI+, incidendo non solo sulla loro libert\u00e0 di espressione e sul diritto alla vita privata, ma anche, pi\u00f9 in profondit\u00e0, sulla loro dignit\u00e0 e sul pieno riconoscimento della loro identit\u00e0 nell\u2019ambito dello spazio giuridico europeo.<\/p>\n\n\n\n<p><strong>Abstract (ENG)<\/strong><\/p>\n\n\n\n<p>The article examines the judgment of the Court of Justice in <em>Commission v Hungary<\/em> (Valeurs de l\u2019Union), focusing on the measures adopted in violation of the rights of LGBTI+ persons under the stated aim of protecting minors. The Court\u2019s ruling represents a significant milestone in the far from linear development of the protection of the rights of sexual minorities within the EU legal order, situated within a broader context marked by growing tensions between the affirmation of the values of equality, human dignity, and non-discrimination, and the adoption, in certain Member States, of measures effectively aimed at limiting the public visibility of sexual and gender identities that do not conform to the dominant model. In this context, the judgment is important not only for the legal solutions it provides, but also for the way in which the Court reconstructs &#8211; consistently with its established case law &#8211; the relationship between internal market freedoms and fundamental rights, placing the latter at the centre of judicial review.
