Abstract (ITA)
Il lavoro prende in considerazione il regolamento 2021/2303 istitutivo dell’Agenzia dell’UE per l’asilo (EUAA) e alcuni degli atti del Nuovo Patto che approfondiscono ed espandono talune competenze dell’Agenzia. Il rafforzamento delle funzioni operative dell’EUAA rappresenta uno dei presupposti per il successo dell’approccio hotspot, modello che viene esteso ed irrigidito dai nuovi regolamenti screening e procedure. Il regolamento 1348/2024, rispetto a quanto previsto dallo statuto dell’EUAA, definisce meglio il ruolo di assistenza che l’Agenzia potrà prestare alla Commissione e agli Stati membri per quanto concerne l’applicazione dei concetti di Paese di origine e terzo sicuro e consolida l’impatto degli atti di soft law dell’Agenzia sui sistemi nazionali. Per quanto concerne, invece, la dimensione esterna del SECA, il nuovo regolamento 2024/1350 approfondisce il mandato dell’Agenzia riconoscendole competenze con riferimento all’ammissione umanitaria.
Abstract (ENG)
The paper deals with Regulation 2021/2303 establishing the EU Asylum Agency (EUAA) and some of the acts of the New Pact that deepen and expand certain competences of the Agency. Strengthening the EUAA’s operational functions is one of the preconditions for the success of the hotspot approach, a model that is extended and tightened by the new screening and procedures regulations. Regulation 1348/2024, compared to the EUAA statute, better defines the Agency’s role in assisting the Commission and the Member States in applying the concepts of Country of Origin and Safe Third Country, and consolidates the impact of the Agency’s soft law acts on national systems. With regard to the external dimension of SECA, the new Regulation 2024/1350 expands the mandate of the Agency by granting it competences with regard to humanitarian admission.
