MARTA FERRARI, The partial and provisional entry into force of the controversial EU-Mercosur trade agreement

ABSTRACT – After more than twenty years of negotiations, an agreement has finally been reached on the text of the EU-Mercosur Agreement. The agreement has been partially in force since 1 May 2026, albeit provisionally. However, the agreement has encountered significant opposition from agricultural sector operators, who claim that it undermines the competitiveness of European businesses, the protection of European consumers’ health and the sustainability objectives set by the European legislator. In light of the agreement’s structure, which is divided into two texts, and these critical issues, the European Parliament considered it essential to seek an advisory opinion from the Court of Justice. This article aims to address the agreement’s most controversial aspects, tracing its development from the initial negotiation stages through to the decision on its provisional application.
