ABSTRACT – The aim of this paper is to analyse Order No. 35 and Judgment No. 36 of the Italian Constitutional Court, filed this past 7 March, in light of the general insights they offer regarding the constitutional relevance of the EU’s internal market law principles, specifically in relation to its fundamental freedoms and the need of national legislators to comply therewith when regulating economic activities.
