Il contributo si occupa dell’Agenzia europea della guardia di frontiera e costiera (Frontex). Creata nel 2004, essa aveva inizialmente un ruolo limitato di assistenza e coordinamento, ma nel corso degli anni, ha acquisito importanti funzioni operative e sono state aumentate le sue risorse umane e finanziarie. Tuttavia, l’esercizio di queste funzioni ha sollevato preoccupazioni sul rispetto dei diritti umani durante le operazioni, soprattutto nei respingimenti e nei salvataggi nel Mediterraneo. Sono esaminati i meccanismi di controllo interni all’Agenzia progressivamente introdotti attraverso i numerosi regolamenti di riforma, che integrano quelli esterni alla medesima, come il Mediatore europeo, il Parlamento europeo, la Corte dei conti e l’OLAF. Viene anche considerato il ruolo della Corte di giustizia dell’UE, anche se i ricorsi proposti hanno incontrato un’interpretazione restrittiva da parte del Tribunale. Nel complesso, questi meccanismi di controllo hanno migliorato la trasparenza di Frontex e il suo atteggiamento nei confronti della tutela dei diritti fondamentali.
Abstract (ENG)
This essay concerns the European Border and Coastguard Agency (Frontex). Created in 2004, it initially had a limited assistance and coordination role, but over the years it has acquired important operational functions and its human and financial resources have been increased. The exercise of these functions has raised concerns about the respect of human rights during operations, especially in refoulements and rescues in the Mediterranean. The Agency’s internal control mechanisms, progressively introduced through the numerous reform regulations, are examined, complementing those outside the Agency, such as the European Ombudsman, the European Parliament, the Court of Auditors and OLAF. The role of the Court of Justice of the EU is also taken into account, although the case law so far shows a restrictive interpretation by the General Court. Overall, these control mechanisms have improved the transparency of Frontex and its attitude towards the protection of fundamental rights.
