Abstract (ITA)
Il presente contributo intende fornire un apprezzamento circa lo stato attuale del processo di adesione dell’Unione alla CEDU, riavviato nel 2019 dopo la fase di stallo susseguitasi al parere 2/13 della CGUE. A tal fine, lo studio si concentra sulla versione definitiva del progetto di accordo di adesione recentemente negoziato in seno al Consiglio d’Europa. In particolare, ne valuta le innovazioni rispetto al progetto precedentemente cassato dalla CGUE e si sofferma sui principali ostacoli che potrebbero impedire il buon esisto del tentativo corrente di adesione dell’Unione.
Abstract (ENG)
The present contribution gives an account of the current stage of the accession process of the EU to the ECHR, which resumed in 2019 after the deadlock following the ECJ’s opinion 2/13. In this sense, the study focuses on the final draft of the accession agreement recently negotiated within the context of the Council of Europe. Specifically, it assesses the innovative aspects of the new text in comparison with the previous version, quashed by the ECJ, and it dwells on the main obstacles that could jeopardise the Union’s current attempt to accede.
