Abstract (ITA)

L’articolo esamina il rapporto tra valori europei, identità europea e società europea. In primo luogo, approfondisce il legame tra i valori fondanti dell’Unione e il concetto di identità europea, sostenendo che la giurisprudenza della Corte di giustizia abbia sviluppato un’identità costituzionale dell’Unione europea. Successivamente, ricostruisce il rapporto tra valori europei e società europea attraverso l’analisi delle conclusioni degli Avvocati generali, mostrando come la nozione di società europea sia emersa ben prima del Trattato di Lisbona e sia stata progressivamente associata alla democrazia, allo Stato di diritto, alla solidarietà e ai diritti fondamentali. Infine, l’articolo sostiene che un’autentica identità europea non possa essere circoscritta alla sua dimensione giuridica, ma richieda che i valori sanciti dall’articolo 2 TUE siano effettivamente attuati nella società. Solo la loro concreta realizzazione può rafforzare il senso di appartenenza dei cittadini all’Unione e accrescere la loro consapevolezza di un’identità europea condivisa, soprattutto nell’attuale contesto internazionale.

Abstract (ENG)

This article examines the relationship between European values, European identity, and European society. It first explores the link between the founding values of the Union and the concept of European identity, arguing that the case law of the Court of Justice has developed a constitutional identity of the European Union. It then reconstructs the relationship between European values and European society through an analysis of the Opinions of the Advocates General, showing that the notion of a European society emerged well before the Treaty of Lisbon and has progressively been associated with democracy, the rule of law, solidarity, and fundamental rights. Finally, the article argues that a genuine European identity cannot be confined to its legal dimension, but requires that the values enshrined in Article 2 TEU be effectively implemented in society. Only their concrete realization can foster citizens’sense of belonging to the Union and strengthen their awareness of a shared European identity, particularly in the current international context.
