Abstract (ITA)
Il contributo analizza le condizioni, attribuite dal diritto nazionale ed europeo, per proporre ricorso e azionare quindi la tutela dei diritti avanti ad un tribunale in applicazione dell’art. 47 della Carta da parte delle associazioni rappresentative degli interessi diffusi. I criteri d’impugnazione previsti dall’art. 263, par. 4, TFUE per l’impugnazione delle parti private, noto come Plaumann test, e conseguentemente il diritto fondamentale di accesso alla giustizia sono analizzati con riferimento al diritto ambientale in parallelismo con quello per la tutela dei dati personali.
Abstract (ENG)
The paper analyzes the conditions, attributed by national and European law, to file an appeal and therefore implement the protection of rights before a court in application of Art. 47 of the Charter by the associations representing widespread interests. The appeal criteria provided for by Art. 263, para. 4, TFEU for the challenge of private parties, also known as the Plaumann test, and consequently the fundamental right of access to justice are analyzed with reference to environmental law in parallel with the right for the protection of personal data.
