Abstract (ITA)
L’articolo propone un’analisi critica del regolamento (UE) 2024/1252 (il Critical Raw Materials Act), adottato dall’Unione europea con lo scopo di garantire un approvvigionamento sicuro e sostenibile di materie prime critiche, le quali risultano necessarie per permettere di conseguire gli obiettivi della transizione verde e della transizione digitale. Pertanto, viene in primo luogo proposto un inquadramento storico e giuridico dell’interesse dell’Unione per le risorse in questione, per poi procedere a illustrare la disciplina del Critical Raw Materials Act. Seguono riflessioni sui partenariati strategici con Stati terzi e sulle criticità che emergono dal regolamento in relazione alle esigenze di tutela dell’ambiente.

The article offers a critical analysis of Regulation (EU) 2024/1252 (the Critical Raw Materials Act), adopted by the European Union with the aim of ensuring a secure and sustainable supply of critical raw materials, which are necessary to achieve the objectives of the green transition and the digital transition. Therefore, the article first provides a historical and legal overview of the Union’s interest in these resources, before going on to outline the provisions of the Critical Raw Materials Act. This is followed by thoughts on strategic partnerships with third countries and the critical issues that emerge from the regulation in relation to environmental protection.
