Abstract (ITA)
All’interno di un contesto in cui è ancora in fieri l’integrazione tra sistemi giuridici nazionali e dell’UE, grande rilievo assume il rapporto tra le corti di vertice dei diversi ordinamenti: le Corti costituzionali da un lato e la Corte di giustizia dall’altro. L’elaborato si prefigge di analizzare le declinazioni di questo rapporto con particolare riferimento alle posizioni assunte negli anni dalla Corte costituzionale italiana. Tra atteggiamenti isolazionisti ed esigenze di riaccentramento del controllo di costituzionalità, anche alla luce dei diritti fondamentali dell’individuo, molteplici sono state negli ultimi decenni le occasioni di dialogo. Lo spunto della ricerca è stato rinvenuto nelle sentenze della Consulta 177 e 178 del 2023: si rileverà come entrambe siano espressione di un cambio di passo nel rapporto tra Corti, sempre più improntato verso una proficua ed effettiva dialettica.
Abstract (ENG)
In a framework in which the integration of national and EU legal systems is still ongoing, the relationship between the Supreme Courts of the different legal systems, the Constitutional Courts on the one hand and the Court of Justice on the other, is of great importance. The paper aims to analyse the declinations of this relationship with particular reference to the positions taken over the years by the Italian Constitutional Court. In recent decades, although switching from isolationist attitudes to centralisation needs regarding constitutional review, also in the light of the fundamental rights of the individual, there have been many opportunities for dialogue. The inspiration of the research was found in the judgments of the Italian Constitutional Court 177 and 178 of 2023: it will be noted that both of them are an expression of a change of course in the relationship between Courts, increasingly marked by a profitable and effective dialectic.
