Abstract (ITA)
In tempi recenti, l’Unione europea, nell’ambito dell’esercizio della sua azione esterna, ha incrementato l’applicazione unilaterale della propria legislazione al di là dei suoi confini territoriali. Tale applicazione unilaterale si realizza con tre diverse modalità, l’applicazione extraterritoriale in senso stretto, l’estensione territoriale della normativa ed il cosiddetto effetto Bruxelles. Il presente contributo, dopo aver analizzato tali modalità applicative, presenta un approfondimento sul meccanismo CBAM come espressione dell’azione esterna dell’Unione, tra effetto Bruxelles ed estensione territoriale.
Abstract (ENG)
In recent times, the European Union, in the exercise of its external action, has increased the unilateral application of its legislation beyond its territorial borders. This unilateral application is achieved through three different methods, the extraterritorial application in a strict sense, the territorial extension of its legislation and the so-called Brussels effect. The present contribution, after having analyzed these application methods, presents an analysis of the CBAM mechanism as an expression of the external action of the Union, between the Brussels effect and the territorial extension.
