Short description

The Court has for the first time decided that third countries are ‘legal persons’ within the meaning of Art. 263(4) TFEU and Art. 275, para 2, TFEU. As a result, they qualify as potential applicants in direct actions before the Court. The right to an effective judicial protection and the rule of law are at the basis of the Court’s interpretation. Is the Court’s position consistent with previous case-law? Is the Court’s stance in line with the position of the common foreign and security policy in the Treaty? Will Venezuela’s action be considered admissible by the General Court?
